Once the resident’s pressure ulcer deteriorated to a Stage III, the defendant Assisted Living Facility was legally required to immediately discharge him to a higher level of care that could meet his increased needs. The Assisted Living Facility colluded with the defendant Medicare Advantage Plan to keep the resident in the Assisted Living Facility and to conceal the true extent of his injuries.
